JONESBORO, Arkansas (AP) — Three men convicted of killing three 8-year-old Cub Scouts and dumping their bodies in an Arkansas ditch changed their pleas Friday, resolving a yearslong effort to win their freedom.
Under a plea bargain, Damien Echols, Jason Baldwin and Jessie Misskelley were being freed immediately. The boys' families were notified about the pact ahead of time but were not asked to approve it.
The defendants, known by their supporters as the West Memphis 3, agreed to a legal maneuver that lets them maintain their innocence while acknowledging prosecutors have enough evidence against them. They were credited with time served, and Echols is being freed from Arkansas' death row. They were placed on 10 years' probation and if they re-offend they could be sent back to prison for 21 years, Prosecutor Scott Ellington said.
"I believe that it would be practically impossible after 18 years to put on a proper trial in this case," Ellington said.
"I believe this case is closed and there are no other individuals involved," he said.
Baldwin and Echols each pleaded guilty to three counts of first-degree murder. Misskelley pleaded guilty to one count of first-degree murder and two counts of second-degree murder. Through a legal maneuver known as an Alford plea, the three men were allowed to maintain their claims of innocence.
Echols' wife, Lorri, sat in the front row of a crowded courtroom, next to Pearl Jam frontman Eddie Vedder, who became a key supporter of the men after watching a pair of HBO documentaries about the case. Vedder put his arm around her during the proceedings.
The three defendants were expected later Friday at a news conference in the courtroom basement.
Circuit Judge David Laser acknowledged the case was complex, and that both the victims' families and the supporters of the three men convicted had suffered. He said he thought Friday's deal would serve justice "the best we can."
"I don't think it will make the pain go away," Laser said during the court proceedings.
One person yelled "Baby killers" as the three left the courtroom.
The May 5, 1993, killings were particularly gruesome. Steve Branch, Christopher Byers and Michael Moore were found nude, and hogtied, and rumors of Satanism roiled the community in the weeks following their deaths. Branch and Moore drowned in about 2 feet of water; Byers bled to death and his genitals were mutilated and partially removed.
Police had few leads until receiving a tip that Echols had been seen mud-covered the night the boys disappeared. The big break came when Misskelley unexpectedly confessed and implicated Baldwin and Echols in the killings.
"Then they tied them up, tied their hands up," Misskelley said in the statement to police, parts of which were tape-recorded. After describing sodomizing and other violence, he went on: "And I saw it and turned around and looked, and then I took off running. I went home, then they called me and asked me, 'How come I didn't stay? I told them, I just couldn't.'"
Misskelley later recanted, and defense lawyers said the then-17-year-old got several parts of the story incorrect. An autopsy said there was no definite evidence of sexual assault. Miskelley had said the older boys abducted the Scouts in the morning, when they had actually been in school all day.
Misskelley was tried separately, convicted of first- and second-degree murder, and sentenced to life in prison plus 40 years. He refused to testify against the others and his confession was not admitted into evidence.
Defense lawyers for Echols and Baldwin alleged juror misconduct, saying they heard about the Misskelley confession anyway. Attorneys also said there wasn't enough physical evidence linking the three to the crime scene.
The Arkansas Supreme Court upheld Echols' conviction and death sentence in 1996, saying there was still enough other evidence to sustain it.
A 1996 HBO documentary, "Paradise Lost: The Child Murders at Robin Hood Hills," drew the attention of celebrities including Vedder and Natalie Maines, lead singer of the Dixie Chicks. They and other celebrities helped fund a legal team that worked to win the three a new trial.
"Why are they innocent?" Vedder said in an interview with The Associated Press last year. "Because there's nothing that says they're guilty."
Last fall, the Arkansas Supreme Court ordered a new hearing for the three and asked a judge to consider allegations of juror misconduct and whether new DNA science could aid the men or uphold the convictions.
In upholding Echols' conviction in 1996, the state Supreme Court noted that two people testified Echols bragged about the killings, an eyewitness put Echols at the scene, fibers similar to the boys' clothing were found in Echols' home, a knife was found in a pond behind Baldwin's home, Echols' interest in the occult and his telling police that he understood the boys had been mutilated before officers had released such details.

The Motorheadbangers Fan club had originally planned to offer fans the opportunity of sending a donation to buy some flowers for Wurzel's funeral. However, Wurzel's family asked that any such donations should go to his favourite charity; Help For Heroes.

At their show at the U-K Sonisphere festival on Sunday, Motorhead paid tribute to their late former bandmate, Michael “Wurzel” Burston, who passed away on Saturday at the age of 61. During their performance, which can be seen on YouTube, singer Lemmy Kilmister said, “We’d like to dedicate this set and our lives to Wurzel.” While no official cause of death has been made, Wurzel is believed to have died due to heart disease.

• TIDBIT: Drummer Mikkey Dee described Wurzel to a Swedish newspaper saying, “He was wonderful. He wrote lots of f***ing great Motorhead riffs. I remember missing that when he was not in the band anymore. I missed the simple, classic Motorhead riffs. We never wrote those after that. They ended with him.”

• TIDBIT: Wurzel was on nine Motorhead albums from 1984’s No Remorse to 1995’s Sacrifice.  

We are greatly saddened to confirm that our long-time friend and comrade Würzel died Saturday at his home.  Würz was pouring a Guinness and cracking a joke when he succumbed to a heart attack; at least we know he went with a smile.

It is a cliche to say that words cannot describe how we feel, and in this case, other than ones such as 'shit' and 'awful' and 'very very sad' it is true, they really can't.

We all shared many many great times together, and what he did for Motörhead is quite simply indelible.  As our good friend Steve 'Krusher' Joule said, "RIP dear Würzel, a rocker and a gentleman."

From Lemmy: “Wurzel was my friend and my brother and he's never going to laugh with me again or bitch me out or do….anything. And that truly and cosmically SUCKS. RIP Wurz Godspeed. Good Man.”

Heavy Metal fans are known for being aggressive and fairly angry people. If you haven’t been to a metal concert let me explain what happens. When the music starts to sprawl out of their speakers, a loud euphoric sense of metal rage starts to engulf the participants in this bastion of ritual mawshing and screaming. Trust me when I say they live up to their reputation, but when one of their own passes away, all past assumptions are thrown out the window. On July 9th, the guitarist from Motörhead died of ventricular fibrillation caused by heart disease. The single named Würzel was 61 when he passed and had all metal fans in tears.

Michael Burston, aka Wurzel, was born in 1949 in Cheltenham, Gloucestershire. He joined Motörhead in 1984 alongside the second guitarist Phil Campbell after Brian Robertson's short-lived time with the group. According to Spinner, Wurzel joined the band after writing a letter to Lemmy, the lead singer of Motorhead: “I wrote [Lemmy] a letter and sent a tape, and he phoned me up for an audition. He also said, 'We'll probably end up with an unknown guitarist', and there was no one in the country who was more unknown than I was.” 

Burston also played on nine studio and live albums with Motörhead. He quit the band in 1995, but after his departure, he would occasionally perform in subsequent albums the group would make. While most of us are thinking this guy is a badass, wait until you hear this: what makes the guitarist more metal than the fans he played too, a term that can be equally enduring, was that he was a corporal in the British Army. It was there where he earned his nickname, Wurzel, on the account of his grizzly appearance, which made him a perfect fit for the rest of this group.

For many fans who listen to heavy metal or hard rock, there are three bands that immediately come to mind when contemplating the precursors to the genre. The first band is Black Sabbath. You know that group, the one who is led by Ozzy Osbourne before his drug addictions carried him away into a crazy train. The next one is Thin Lizzy, the only hard rock group of that time who had an Irish black guy as the lead singer. Finally, the group that inspires most people to cherish their Slayer records with heightened anger is that little band from London, Motorhead. Throughout the late 1970’s and 80’s Motorhead spread it’s metal wings to a wide range of audiences and was, along with Sabbath and Thin Lizzy, one of the founders of heavy metal. Wurzel's legacy won’t be forgotten.

titled, “Hollywood Hillbillies” was written by Sharynlee. It covers the fascination of

This is the first country music collaboration for the well- known rock and roll star.

According to Management, they were all surprisingly shocked with Lemmy’s

performance and the production of this project. He sounds genuinely authentic on

the Two-Steppin’ and classic Line Dancing style music track. The two voices blend

well together, with Sharynlee’s touch of smooth twang, yet, sometime rough vocal,

up against Lemmy’s raspy sound. “He reminds me of a young Kris Kristofferson,

and he sang with such ease,” says Sharynlee. “He was so much fun to work with,

while very serious; even, to the extent of reminding me to sing a word in the same

manner of my natural southern dialect,” she further explains.

What on earth does a Black Female American Country Music Singer, and a British

Heavy Metal Rocker have in common? A little over a decade the two met while

attending an Alice Cooper Concert in West Hollywood. There, they discovered

mutual admirations, including individual memorable experiences in North Carolina, a

love of Merle Haggard’s music, and songwriting. For certain the two voices teamed

up on, “Hollywood Hillbillies” are magical and mesmerizing, as ironic and

coincidental, as their first meeting. Don’t mistake this as a fluke. They intend to

Conan O'Brien on TBS January 26th
